New Orleans, LA - November 20, 2009 - "Wednesday’s ruling in the case of Franz et al. v the United States (Corps of Engineers) was at best bittersweet. The Historic Lower Ninth Ward community, which has a documented history of surviving catastrophic disasters, has finally been granted approval by the Federal Court to move forward in being made whole for damages that were caused by the Mississippi River Gulf Outlet. As the district representative I am happy that this community has been given this long awaited and much deserved victory.
"However, inasmuch as I represent the Lower Ninth Ward I must also stand up and dissent.
"It is my understanding that the judge made his ruling given the facts presented before him, but I encourage those left out not to be dismayed.
"I will be meeting with the City Attorney to further explore our options for the residents of Eastern New Orleans. I applaud the judge for acknowledging the fault of the government relative to the lack of maintenance of Mississippi River – Gulf Outlet (MR-GO), but I feel that we would like the courts to re-examine the technical data. Equally, I ask the community to unite with a purpose. This is just another testimony of our resilience and just as victory has been achieved for the Lower Ninth Ward and St. Bernard Parish, it is hoped that it will soon come for other areas devastated by our lack of storm protection."
